Terms & Conditions

1. Booking and Payments​

  • Payment: Full payment is due on the day you book. Accepted payment methods include credit card, PayPal, bank transfer or cash.

  • Cancellations: Cancellations and reschedules need to be made 48 hours in advance minimum for a refund.
     

2. Use of Studio

  • Studio Access: Clients are allowed to use the studio space for the duration of their booked time only. Additional time will be charged at the hourly rate.

  • Equipment: Any equipment provided by the studio must be used responsibly. Damages caused by negligence will result in repair or replacement charges.

  • Cleanliness: The studio should be left in the same condition as found. A cleaning fee may be charged if the space is left in an unacceptable state.
     

3. Liability

  • Injury: The studio is not liable for any injuries sustained by clients or their guests while on the premises.

  • Property: The studio is not responsible for loss or damage to personal belongings brought into the studio.
     

4. Image Rights

  • Client Usage: The client is granted rights to use the photographs and videos for personal or commercial use, as agreed upon in writing.

  • Studio Usage: The studio retains the right to use any images or videos captured on-site for promotional purposes unless otherwise agreed in writing.


5. Hiring Photographers, Videographers, Creatives, and Models

  • Creative Professionals: If the client hires the studio’s photographers, videographers, or other creative professionals (such as makeup artists, stylists, etc.), these individuals will perform their services as independent contractors. The studio will not be held responsible for the final creative output, delays, or unforeseen circumstances affecting their services.
     

  • Models: If the client hires models through the studio, it is the client’s responsibility to communicate specific requirements (e.g., wardrobe, look, poses). Any dissatisfaction with model performance must be raised during the shoot. Post-shoot complaints about models will not result in refunds.
     

  • Usage Rights for Hired Talent: The client agrees to use the services and content created by hired photographers, videographers, and models solely for the purposes outlined in the agreement. If additional uses are required, the client must obtain written permission and may incur extra charges.
     

  • Work Hours and Overtime: The hired photographers, videographers, creatives, and models are available for the duration specified in the booking. Any work exceeding the agreed-upon hours will be billed at an overtime rate, which must be settled on the day of the shoot.
     

  • Client Responsibilities: It is the client’s responsibility to provide a clear brief and expectations for the shoot. Any changes to the scope of work must be communicated in advance. Last-minute changes may result in additional charges or delays.
     

6. Confidentiality

  • Privacy: Any personal or business information shared with the studio will remain confidential and will not be shared with third parties.
     

7. Force Majeure

  • Unforeseen Events: The studio is not responsible for cancellations due to events beyond its control, such as natural disasters or power outages. In such cases, bookings will be rescheduled or refunded at the studio's discretion.
     

8. Revisions and Edits

  • Initial Edits: The studio or hired creatives will provide a specified number of edits/revisions as part of the agreement. Any additional edits requested by the client will be subject to extra charges.

  • Delivery Timeline: Final images and videos will be delivered within the agreed timeframe. Delays in client feedback may result in an extended delivery timeline.
     

9. Model and Talent Release

  • Model/Talent Release Forms: If models or talent are hired through the studio, all parties must sign a release form granting permission for the use of their likeness in photos and videos for the specified project.

  • Client-Supplied Models: If the client supplies models or talent, it is the client’s responsibility to secure signed release forms for the use of their likeness. The studio is not liable for any disputes related to image rights or usage for client-supplied models.
     

10. Client Conduct and Responsibilities

  • On-Site Behaviour: Clients, their guests, and hired talent are expected to behave professionally while on studio premises. Disrespectful or disruptive behaviour may result in termination of the session without refund.

  • Damage: Clients will be held responsible for any damage to studio property caused by themselves, their guests, or hired talent during their session.
     

11. Permits and Legal Requirements

  • Permits: It is the client’s responsibility to obtain any necessary permits for shoots that take place outside of the studio or involve public spaces. The studio is not responsible for any legal issues arising from the client’s failure to secure the necessary permits.

  • Compliance with Laws: All projects must comply with local, state, and federal laws. The studio reserves the right to refuse or terminate projects that involve illegal or unethical content or behaviour.
     

12. Non-Disclosure Agreement (NDA)

  • Confidential Projects: If the client wishes to keep the project confidential, a Non-Disclosure Agreement (NDA) must be signed by all parties involved. This ensures that no information, images, or videos are shared without prior written consent.
     

13. Travel and Accommodation (for Off-Site Shoots)

  • Travel Fees: If the client requires the studio’s photographers, videographers, or creatives to work off-site, travel and accommodation expenses will be charged in addition to the agreed project fee. This will be discussed and agreed upon in advance.

  • Location Shoots: Clients must ensure that all off-site locations are safe and suitable for the shoot. The studio reserves the right to refuse a location if it is deemed unsafe or inappropriate.
     

14. Postponement

  • Client-Initiated Postponements: If the client needs to postpone the shoot, a rescheduling fee may apply. Postponements must be requested at least 48 hours before the scheduled time.

  • Weather-Related Postponements: For outdoor shoots, if inclement weather affects the shoot, the client and studio may agree on a postponement without any fees. However, any costs incurred for permits or third-party bookings may still be charged.
     

15. Termination of Contract

  • Breach of Contract: The studio reserves the right to terminate any agreement with the client if there is a breach of these terms and conditions, such as failure to make payments or violations of studio policies.

  • Refunds: In cases where the client is at fault for contract termination, no refunds will be provided. However, the studio may consider partial refunds for specific circumstances at its discretion.
     

16. Health and Safety

  • COVID-19 or Other Health Protocols: Clients, their guests, and hired talent must adhere to any health and safety protocols in place at the time of the shoot. This includes, but is not limited to, mask-wearing, social distancing, and sanitisation.

  • Illness: If the client, any guests, or hired talent exhibit symptoms of illness, the studio reserves the right to reschedule the shoot to protect the health of all involved.
     

17. Dispute Resolution

  • Mediation/Arbitration: In the event of a dispute, both parties agree to seek resolution through mediation or arbitration before pursuing legal action.

  • Legal Fees: Should legal action be necessary, the prevailing party will be entitled to recover legal fees and any other associated costs from the other party.
     

18. Governing Law

  • Jurisdiction: These terms and conditions are governed by the laws of the United Kingdom. Any disputes will be resolved in the courts of the United Kingdom.
     

19. Agreement

  • Acceptance: By booking and using the studio, the client agrees to these terms and conditions.
